1. Acceptance of Terms

By accessing our website or engaging Afterglow Christmas Lights ("Afterglow," "we," "our," or "us") for holiday lighting services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our website or services. These terms apply to all visitors, customers, and anyone who interacts with Afterglow.

2. Services

Afterglow provides professional holiday lighting programs for residential and light commercial properties, including custom design, installation, in-season maintenance, takedown, and off-season storage. All services are subject to a written scope of work and a fixed price agreed upon by both parties before work begins.

3. Program Structure and Ownership of Materials

Afterglow lighting programs are all-inclusive seasonal service agreements. Unless otherwise stated in writing, all lights, clips, cords, timers, and related materials remain the property of Afterglow Christmas Lights at all times. Your program fee covers the design, use, installation, maintenance, takedown, and storage of these materials for the season. Materials are custom-cut to your roofline and reserved for your home for as long as your program remains active.

4. Quotes and Pricing

All quotes provided by Afterglow are:

  • Valid for 14 days from the date of issue

  • Based on the property scope visible in photos or confirmed during design review

  • Subject to adjustment if the actual property conditions differ materially from what was represented. We will notify you and obtain approval before proceeding with any change.

  • Fixed once accepted. No hidden fees.

Programs start at $995. Your renewal rate is locked at your founding rate for as long as your program remains continuously active, subject to Section 12.

5. Payment Terms

  • Payment terms and any deposit requirements are stated in your written quote.

  • Balance is due upon completed installation unless otherwise agreed in writing.

  • Accepted payment methods: major credit cards, bank transfer, and check.

  • Overdue balances beyond 30 days are subject to a 1.5% monthly interest charge where permitted by applicable law.

6. Scheduling and Weather

Installation and takedown dates are scheduled in advance and confirmed with you. Severe weather, high winds, or unsafe roof conditions may require rescheduling for crew safety. We will notify you promptly and reschedule at the earliest safe opportunity. Weather-related rescheduling does not entitle the customer to a refund, provided services are completed within the season.

7. Service Guarantee

If any part of your display stops working during the season, we will repair or replace it within 72 hours of your report at no charge. This guarantee covers product failure, weather displacement, and installation issues. It does not cover damage caused by intentional acts, unauthorized modification of the display, animals, or acts of God that make roof access unsafe, in which case we will complete the fix as soon as conditions allow.

8. Property Access

By scheduling installation or service, you authorize our crew to access the exterior of the property, including the roofline, at the scheduled times. We will not access interior areas of the property. You are responsible for ensuring exterior electrical outlets are functional and accessible, and for securing pets during service visits.

9. Customer Responsibilities

  • Provide functioning exterior power outlets sufficient for the display

  • Do not modify, move, or remove any part of the installed display. Unauthorized modification voids the service guarantee for the affected area.

  • Report any issues promptly so we can meet our 72-hour fix commitment

  • Notify us of any changes to the property that affect installation (roof work, painting, construction)

10. Takedown and Storage

Takedown is included in your program and is completed after the holiday season within the window stated in your agreement. Lights are inspected, repaired as needed, labeled, and stored by Afterglow at no additional charge. Stored materials remain the property of Afterglow.

11. Cancellation Policy

  • You may cancel a signed program within 3 business days of signing for a full refund of any deposit.

  • Cancellations after materials have been custom-cut for your home but before installation are subject to a restocking fee equal to the cost of custom preparation.

  • Cancellations after installation has begun will be billed for all work completed and materials prepared to that point.

  • Non-renewal for a future season may be done at any time before the renewal deposit is paid, with no penalty. Non-renewal releases your locked rate.

12. Rate Lock

Your founding-season rate is locked for future seasons provided your program renews each consecutive season and your property scope remains materially the same. Additions to the display (for example, adding trees or additional rooflines) are quoted separately and added to the locked base. If your program lapses for a season, re-enrollment is at then-current pricing.

13. Limitation of Liability

Afterglow's total liability for any claim arising from our services shall not exceed the total amount paid by the customer for the season in question. We are not liable for indirect, incidental, or consequential damages, including loss of use or loss of enjoyment. We carry liability insurance covering our work on your property, and we are responsible for damage to your property directly caused by our crew's negligence.

14. Dispute Resolution

In the event of a dispute arising from our services, both parties agree to attempt resolution through direct communication first. If unresolved within 30 days, disputes will be submitted to binding arbitration in Hillsborough County, Florida, in accordance with the rules of the American Arbitration Association.

15. Governing Law

These Terms and Conditions are governed by the laws of the State of Florida. Any legal proceedings shall be held in the county where the services were performed.

16. Website Use

The content on the Afterglow website, including text, images, logos, and graphics, is the property of Afterglow Christmas Lights and protected by copyright law. You may not reproduce, distribute, or use our content without written permission. The website is provided "as is" and we make no warranties regarding uptime, accuracy, or completeness of information.

17. Changes to These Terms

We reserve the right to update these Terms and Conditions at any time. Changes will be posted on this page with an updated date. Continued use of our website or services after changes are posted constitutes acceptance of the revised terms.
